Mental Growth Academy (hierna "MGA", "wij" of "ons"), met maatschappelijke zetel te Brugge, België, hecht groot belang aan de bescherming van jouw persoonsgegevens. Deze privacyverklaring beschrijft hoe wij gegevens verzamelen, gebruiken en beschermen via onze website (mentalgrowthacademy.be) en de webshop daarop, de MGA-app en de MGA Coach-chatbot.

Wij verwerken persoonsgegevens in overeenstemming met de Algemene Verordening Gegevensbescherming (AVG/GDPR — Verordening (EU) 2016/679) en de Belgische privacywetgeving.

MGA is opgericht door kinderarts Tania Claeys en topsportcoach Jelle Vanhee, met als doel kinderen, ouders en coaches te ondersteunen via de Smart Reset Methode™ (SRM). Verantwoordelijke voor gegevensbescherming: Tania Claeys.

Toepassingsgebied

Deze privacyverklaring is van toepassing op alle diensten van Mental Growth Academy:

Door gebruik te maken van één of meer van deze diensten bevestigt u dat u deze privacyverklaring hebt gelezen. Voor minderjarigen geldt dat een ouder of wettelijke vertegenwoordiger mede toestemming verleent.

Welke gegevens verzamelen wij?

Via de MGA-app

• Naam en e-mailadres (bij registratie)
• Rol: speler, ouder, trainer of beheerder
• Werkboek en leeftijdscategorie
• Driehoek van Groei, intenties en trainingsgegevens
• Inzichten rond fysieke en mentale belasting
• QR-koppelingen speler — ouder — trainer
• Technische data (authenticatie, foutopvolging)
• Geanonimiseerde onderzoeksdata — enkel met expliciete toestemming

Via de website

• Geanonimiseerde bezoekersstatistieken via Plausible Analytics (cookieloos, geen persoonsgegevens)
• Contactformuliergegevens: naam, e-mailadres, bericht — enkel indien u contact opneemt

Via de webshop

• Naam en e-mailadres
• Leveradres — enkel bij verzending; bij afhaling bij Brughia bewaren wij geen adres
• Bestelinhoud (welk boek, aantal) en betaalstatus
• Indien u dit zelf aanvinkt: uw e-mailadres om u af en toe een update te sturen over een nieuw boekje of programma

Via de MGA Coach (chatbot)

• E-mailadres voor de aanmelding (magic-link login)
• Een toestemmingsrecord: wie, wanneer en welke versie van de toestemming
• Een gebruiksteller
• De tekst die u intypt, en de taal en het tijdstip van het gesprek
• Wij bewaren de inhoud van uw gesprekken zelf niet. Die wordt wel naar Anthropic verzonden om een antwoord te genereren (zie §11).

Doeleinden en rechtsgrond

• App-gebruik — uitvoering van de overeenkomst (Art. 6(1)(b) AVG)
• Webshop en bestellingen — uitvoering van de overeenkomst (Art. 6(1)(b) AVG); het bewaren van factuurgegevens steunt op een wettelijke verplichting (Art. 6(1)(c) AVG)
• Updates over nieuwe boekjes (optioneel) — toestemming (Art. 6(1)(a) AVG), enkel indien u het vinkje aankruist; intrekbaar op elk moment
• Chatbot-gebruik — toestemming van de gebruiker (Art. 6(1)(a) AVG), gevraagd vóór aanvang van het gesprek
• Gezondheidsgegevens via de chatbot — expliciete toestemming van de gebruiker (Art. 9(2)(a) AVG), gevraagd vóór aanvang van het gesprek

• E-mailcommunicatie — gerechtvaardigd belang of toestemming, afhankelijk van context

Verwerkers en ontvangers

Wij verkopen jouw persoonsgegevens nooit aan derden. Met alle verwerkers sluiten wij een verwerkersovereenkomst (DPA) af conform Art. 28 AVG.

Google Cloud / Firebase

• Functie: opslag van app-data, en van het account, het toestemmingsrecord en de gebruiksteller van de MGA Coach
• Coach-data (account, toestemming, teller): EU-regio europe-west1 (België)
• App-data: regio europe-west2 (Londen, Verenigd Koninkrijk) — zie §11 over de doorgifte naar het VK

Anthropic PBC (Claude API) — Verenigde Staten

• Functie: het onderliggende AI-model van de MGA Coach
• Tekst die gebruikers intypen wordt verzonden naar Anthropic om een antwoord te genereren
• Anthropic gebruikt API-gegevens niet voor modeltraining (standaard opt-out via API-voorwaarden)
• Juridische waarborg: Standaard Contractuele Clausules (SCC's) — Module 2, opgenomen in de Anthropic Data Processing Addendum (Art. 46(2)(c) AVG)
• Transfer Impact Assessment: wordt opgemaakt samen met onze gegevensbeschermingsadviseur

Plausible Analytics — EU

• Functie: cookieloze websitestatistieken, volledig geanonimiseerd
• Servers: EU — geen persoonsgegevens, geen cookies, geen consent nodig

Mollie — betalingsverwerking (EU/Nederland)

• Functie: verwerking van online betalingen (o.a. Bancontact) voor bestellingen via de webshop
• Servers: EU (Nederland)

Brevo — bevestigingsmails (EU/Frankrijk)

• Functie: versturen van de bestelbevestiging per e-mail
• Servers: EU (Frankrijk)

Afhaling bij Brughia

• Afhaalbestellingen worden door MGA zelf klaargelegd en overhandigd; hiervoor schakelen wij geen externe verwerker in

Overheidsinstanties

• Enkel indien wettelijk verplicht

Bijzondere categorieën persoonsgegevens

In gesprekken met de MGA Coach kan gezondheidsgerelateerde informatie over een kind aan bod komen, zoals een diagnose (bv. ASS, ADHD, angst). Deze informatie valt onder de bijzondere categorieën van Art. 9(1) AVG. In de praktijk is de gebruiker meestal een ouder, die deze informatie deelt en de verwerking ervan toestaat, ook namens zijn minderjarige kind.

De verwerking steunt op de uitdrukkelijke toestemming van de gebruiker (Art. 9(2)(a) en Art. 6(1)(a) AVG). Die toestemming wordt vóór het gesprek actief gegeven via een vinkje en met versienummer geregistreerd. Wie de toestemming niet geeft, gebruikt de chatbot niet. De toestemming kan op elk moment worden ingetrokken, waarna het account en de bewaarde gegevens kunnen worden gewist (zie §8).

Het beginsel van dataminimalisatie blijft gelden: deel enkel wat nodig is. De MGA Coach is geen medisch hulpmiddel. Bij ernstige zorgen over een kind raden wij aan contact op te nemen met een arts, psycholoog of erkende hulpverlener.

Bewaartermijnen

• App-accountgegevens — bewaard zolang het account actief is, daarna verwijderd binnen 30 dagen
• Geanonimiseerde onderzoeksdata — bewaard na accountverwijdering voor wetenschappelijk onderzoek, enkel indien toestemming gegeven bij registratie
• Chatbot-gesprekken (MGA Coach) — wij bewaren uw gesprekken niet; ze worden maximaal 30 dagen op Anthropic-servers bewaard
• Account MGA Coach (e-mailadres) — bewaard tot u uw account verwijdert
• Toestemmingsrecord — bewaard zolang nodig als bewijs, plus de wettelijke termijn
• Gebruiksteller — bewaard zolang het account actief is
• Bestelgegevens webshop — naam, adres en bestelinhoud worden bewaard zolang nodig voor de afhandeling en, voor de factuurgegevens, gedurende de wettelijke bewaarplicht (7 jaar)
• E-mailadres voor updates (optioneel) — bewaard tot u zich uitschrijft of uw toestemming intrekt
• Website-analytics — geanonimiseerd, maximaal 14 maanden (Plausible-instelling)
• E-mails via contactformulier — maximaal 2 jaar na laatste contact
• Boekhoudkundige gegevens — 7 jaar (wettelijke bewaarplicht)

Uw rechten

Onder de AVG/GDPR hebt u de volgende rechten:

• Recht op inzage (Art. 15) — u kan opvragen welke gegevens wij over u bewaren
• Recht op rectificatie (Art. 16) — u kan onjuiste gegevens laten corrigeren
• Recht op verwijdering (Art. 17) — u kan vragen uw gegevens te wissen ("recht op vergetelheid")
• Recht op beperking (Art. 18) — u kan de verwerking laten beperken
• Recht op gegevensoverdraagbaarheid (Art. 20) — u kan uw gegevens in een leesbaar formaat opvragen
• Recht van bezwaar (Art. 21) — u kan bezwaar maken tegen verwerking op basis van gerechtvaardigd belang
• Recht om toestemming in te trekken (Art. 7(3)) — ten allen tijde, zonder gevolgen voor voorgaande verwerking

Beveiliging

• Alle dataverbindingen verlopen via HTTPS/TLS-encryptie
• App-data opgeslagen in beveiligde Firebase-omgeving met toegangscontrole per rol
• Chatgesprekken verzonden via beveiligde API-verbinding
• Intern toegangsbeheer: enkel Tania Claeys heeft toegang tot gebruikersdata en systemen

Bij een datalek dat een risico inhoudt voor uw rechten, informeren wij u zo snel mogelijk en melden wij dit bij de Gegevensbeschermingsautoriteit binnen 72 uur (Art. 33 AVG).

Minderjarigen

Website — vrij toegankelijk

De website mentalgrowthacademy.be is vrij toegankelijk voor alle leeftijden. Informatieve content over de Smart Reset Methode is bedoeld voor een breed publiek, inclusief jongeren.

MGA Coach (chatbot) — uitsluitend voor 18+

De MGA Coach is uitdrukkelijk bedoeld voor volwassenen van 18 jaar en ouder. Vóór elk gesprek bevestigt de gebruiker dit actief door een apart vinkje "Ik ben 18 jaar of ouder" aan te kruisen, naast een tweede vinkje waarmee toestemming voor de verwerking wordt gegeven. Het gesprek kan pas starten wanneer beide vinkjes zijn aangekruist.

Jongeren die zelf vragen hebben over spanning of emotie worden doorverwezen naar de Jongerenlijn (102) — gratis, anoniem, voor jongeren tot 25 jaar.

MGA-app — vanaf 12 jaar

De MGA-app is bedoeld voor spelers vanaf 12 jaar, ouders en trainers. Bij registratie van een gebruiker jonger dan 16 jaar bevestigt een ouder of wettelijke vertegenwoordiger mede akkoord (Art. 8 AVG).

Internationale doorgifte

De MGA Coach maakt gebruik van de Claude API van Anthropic PBC, gevestigd in de Verenigde Staten. Wanneer u een bericht typt in de chatbot, wordt dat bericht verzonden naar servers van Anthropic in de VS om een antwoord te genereren.

Juridische waarborgen

• Standaard Contractuele Clausules (SCC's) — Module 2 (verwerkingsverantwoordelijke naar verwerker), opgenomen in Schedule 3 van de Anthropic Data Processing Addendum (Art. 46(2)(c) AVG)
• Transfer Impact Assessment wordt opgemaakt samen met onze gegevensbeschermingsadviseur, conform de SCCs en met ondersteuning van Anthropic via Section I.4 van de DPA
• Anthropic verwerkt API-gegevens niet voor modeltraining — standaard opt-out
• Anthropic is gecertificeerd onder SOC 2 Type I & II, ISO 27001:2022 en ISO/IEC 42001:2023

Verenigd Koninkrijk — app-data

De databank van de MGA-app staat in de regio europe-west2 (Londen, Verenigd Koninkrijk). Sinds de Brexit is het VK een derde land. De doorgifte steunt op het adequaatheidsbesluit van de Europese Commissie voor het Verenigd Koninkrijk, dat een passend beschermingsniveau erkent (Art. 45 AVG). De gegevens van de MGA Coach (account, toestemmingsrecord, gebruiksteller) blijven in de EU-regio europe-west1 (België).

Cookies

Voor cookies geldt: enkel strikt noodzakelijke, functionele cookies mogen zonder toestemming worden geplaatst. Elke niet-functionele cookie (bijvoorbeeld analytics of advertenties van derden) vereist uw voorafgaande toestemming via een opt-in. Wij informeren u hierover steeds via deze cookieverklaring.

Functionele cookies en lokale opslag

• Sessiecookies voor de werking van de website (strikt noodzakelijk)
• Lokale browseropslag om uw aanmelding via magic-link te voltooien — functioneel, blijft op uw eigen toestel

Analytics zonder cookies

Voor bezoekersstatistieken gebruiken wij Plausible Analytics, een cookieloos en privacyvriendelijk pakket dat geen persoonsgegevens verwerkt en geen toestemming vereist.

Webshop

De betaling verloopt via Mollie. In de huidige opzet gebruiken wij op onze eigen website geen tracking- of advertentiecookies. Mocht bij de betaling toch een niet-functionele cookie worden geplaatst, dan voorzien wij hiervoor een voorafgaande toestemming via een cookiebanner.

Medische disclaimer & crisisprotocol

De MGA Coach en de MGA-app zijn pedagogische hulpmiddelen. Zij vervangen geen medisch, psychologisch of therapeutisch advies. Bij signalen van een acute crisis verwijst de chatbot door naar erkende Belgische hulplijnen.

Wijzigingen

Wij behouden ons het recht voor deze privacyverklaring te wijzigen wanneer onze diensten of de wetgeving dit vereisen. De meest recente versie is steeds beschikbaar via onze website. Bij ingrijpende wijzigingen brengen wij actieve gebruikers per e-mail op de hoogte.

Mental Growth Academy (hereinafter "MGA", "we" or "us"), with registered office in Bruges, Belgium, attaches great importance to the protection of your personal data. This privacy policy describes how we collect, use and protect data through our website (mentalgrowthacademy.be) and the webshop on it, the MGA app and the MGA Coach chatbot.

We process personal data in accordance with the General Data Protection Regulation (GDPR — Regulation (EU) 2016/679) and Belgian privacy legislation.

What data do we collect?

Through the MGA app

• Name and email address (on registration)
• Role: player, parent, coach or administrator
• Workbook and age category
• Growth Triangle, intentions and training data
• Insights regarding physical and mental load
• QR links between player, parent and coach
• Technical data (authentication, error tracking)
• Anonymised research data — only with explicit consent

Through the website

• Anonymised visitor statistics via Plausible Analytics (cookieless, no personal data)
• Contact-form data: name, email address, message — only if you contact us

Through the webshop

• Name and email address
• Delivery address — only for shipping; for pickup at Brughia we do not store an address
• Order contents (which book, quantity) and payment status
• If you tick the box yourself: your email address to send you occasional updates about a new booklet or programme

Through the MGA Coach (chatbot)

• Email address for sign-in (magic-link login)
• A consent record: who, when and which version of the consent
• A usage counter
• The text you type, and the language and time of the conversation
• We do not store the content of your conversations ourselves. It is sent to Anthropic to generate a response (see §11).

Purposes and legal basis

• App use — performance of the contract (Art. 6(1)(b) GDPR)
• Webshop and orders — performance of the contract (Art. 6(1)(b) GDPR); retention of invoice data rests on a legal obligation (Art. 6(1)(c) GDPR)
• Updates about new booklets (optional) — consent (Art. 6(1)(a) GDPR), only if you tick the box; withdrawable at any time
• Chatbot use — consent of the user (Art. 6(1)(a) GDPR), requested before the conversation begins
• Health data via the chatbot — explicit consent of the user (Art. 9(2)(a) GDPR), requested before the conversation begins
• Website analytics — legitimate interest (Art. 6(1)(f) GDPR), fully anonymised via Plausible
• Email communication — legitimate interest or consent, depending on context
• Scientific research — explicit consent at registration (Art. 6(1)(a) GDPR)

Processors and recipients

We never sell your personal data to third parties. With all processors we conclude a data processing agreement (DPA) in accordance with Art. 28 GDPR.

Google Cloud / Firebase

• Function: storage of app data, and of the account, consent record and usage counter of the MGA Coach
• Coach data (account, consent, counter): EU region europe-west1 (Belgium)
• App data: region europe-west2 (London, United Kingdom) — see §11 on the transfer to the UK

Anthropic PBC (Claude API) — United States

• Function: the underlying AI model of the MGA Coach
• Text that users type is sent to Anthropic to generate a response
• Anthropic does not use API data for model training (default opt-out under the API terms)
• Legal safeguard: Standard Contractual Clauses (SCCs) — Module 2, included in the Anthropic Data Processing Addendum (Art. 46(2)(c) GDPR)

Plausible Analytics — EU

• Function: cookieless website statistics, fully anonymised
• Servers: EU — no personal data, no cookies, no consent required

Mollie — payment processing (EU/Netherlands)

• Function: processing online payments (incl. Bancontact) for webshop orders
• Servers: EU (Netherlands)

Brevo — confirmation emails (EU/France)

• Function: sending the order confirmation by email
• Servers: EU (France)

Pickup at Brughia

• Pickup orders are prepared and handed over by MGA itself; no external processor is involved

• Only where legally required

Special categories of personal data

Conversations with the MGA Coach may touch on health-related information about a child, such as a diagnosis (e.g. ASD, ADHD, anxiety). This information falls under the special categories of Art. 9(1) GDPR. In practice the user is usually a parent, who shares this information and consents to its processing, also on behalf of their minor child.

The processing relies on the explicit consent of the user (Art. 9(2)(a) and Art. 6(1)(a) GDPR). This consent is given actively before the conversation via a tick box and recorded with a version number. Anyone who does not give consent does not use the chatbot. Consent can be withdrawn at any time, after which the account and stored data can be erased (see §8).

The principle of data minimisation continues to apply: share only what is necessary. The MGA Coach is not a medical device. For serious concerns about a child, we advise contacting a doctor, psychologist or accredited care provider.

Retention periods

• App account data — retained while the account is active, then deleted within 30 days
• Anonymised research data — retained after account deletion for scientific research, only if consent was given at registration
• Chatbot conversations (MGA Coach) — we do not store your conversations; they are kept on Anthropic servers for a maximum of 30 days
• MGA Coach account (email address) — kept until you delete your account
• Consent record — kept as long as needed as evidence, plus the statutory period
• Usage counter — kept while the account is active
• Webshop order data — name, address and order contents are kept as long as needed for fulfilment and, for invoice data, for the legal retention period (7 years)
• Email address for updates (optional) — kept until you unsubscribe or withdraw consent
• Website analytics — anonymised, maximum 14 months (Plausible setting)
• Emails via the contact form — maximum 2 years after last contact
• Accounting data — 7 years (legal retention obligation)

Your rights

Under the GDPR you have the following rights:

• Right of access (Art. 15) — you can request which data we hold about you
• Right to rectification (Art. 16) — you can have inaccurate data corrected
• Right to erasure (Art. 17) — you can ask for your data to be erased ("right to be forgotten")
• Right to restriction (Art. 18) — you can have the processing restricted
• Right to data portability (Art. 20) — you can request your data in a readable format
• Right to object (Art. 21) — you can object to processing based on legitimate interest
• Right to withdraw consent (Art. 7(3)) — at any time, without affecting prior processing

Security

• All data connections run via HTTPS/TLS encryption
• App data stored in a secured Firebase environment with role-based access control
• Chat conversations sent via a secured API connection
• Internal access management: only Tania Claeys has access to user data and systems

In the event of a data breach that poses a risk to your rights, we will inform you as soon as possible and report it to the Data Protection Authority within 72 hours (Art. 33 GDPR).

Minors

Website — freely accessible

The website mentalgrowthacademy.be is freely accessible to all ages. Informative content about the Smart Reset Method is intended for a broad audience, including young people.

MGA Coach (chatbot) — for adults 18+ only

The MGA Coach is expressly intended for adults aged 18 and over. Before each conversation, the user actively confirms this by ticking a separate checkbox "I am 18 years or older", alongside a second checkbox giving consent for the processing. The conversation can only start once both checkboxes are ticked.

Young people with their own questions about tension or emotion are referred to the Jongerenlijn (102) — free, anonymous, for young people up to 25 years.

MGA app — from age 12

The MGA app is intended for players from age 12, parents and coaches. When registering a user under 16, a parent or legal representative co-confirms agreement (Art. 8 GDPR).

International transfer

The MGA Coach uses the Claude API of Anthropic PBC, established in the United States. When you type a message into the chatbot, that message is sent to Anthropic's servers in the US to generate a response.

Legal safeguards

• Standard Contractual Clauses (SCCs) — Module 2 (controller to processor), included in Schedule 3 of the Anthropic Data Processing Addendum (Art. 46(2)(c) GDPR)
• Transfer Impact Assessment being prepared together with our data protection adviser, in line with the SCCs and supported by Anthropic via Section I.4 of the DPA
• Anthropic does not process API data for model training — default opt-out
• Anthropic is certified under SOC 2 Type I & II, ISO 27001:2022 and ISO/IEC 42001:2023

United Kingdom — app data

The MGA app database is located in the region europe-west2 (London, United Kingdom). Since Brexit, the UK is a third country. The transfer relies on the European Commission's adequacy decision for the United Kingdom, which recognises an adequate level of protection (Art. 45 GDPR). The MGA Coach data (account, consent record, usage counter) remains in the EU region europe-west1 (Belgium).

Cookies

The rule for cookies: only strictly necessary, functional cookies may be placed without consent. Every non-functional cookie (for example analytics or third-party advertising) requires your prior consent via an opt-in. We always inform you about this through this cookie statement.

Functional cookies and local storage

• Session cookies for the operation of the website (strictly necessary)
• Local browser storage to complete your magic-link sign-in — functional, stays on your own device

Cookieless analytics

For visitor statistics we use Plausible Analytics, a cookieless and privacy-friendly package that processes no personal data and requires no consent.

Webshop

Payment runs via Mollie. In the current setup we use no tracking or advertising cookies on our own website. Should a non-functional cookie nevertheless be placed during payment, we will provide prior consent for it via a cookie banner.

Medical disclaimer & crisis protocol

The MGA Coach and the MGA app are educational tools. They do not replace medical, psychological or therapeutic advice. At signs of an acute crisis, the chatbot refers to accredited Belgian helplines.

Changes

We reserve the right to amend this privacy policy when our services or legislation so require. The most recent version is always available on our website. For significant changes, we notify active users by email.
